The article is devoted to the issues of rational use of land in Ukrainian settlements and its ownership allocation (lease) outside of land auctions. It is relevant given global trends of increasing land use for construction, transport, and industrial facilities because of urbanization and industrialization, as well as internal factors in Ukraine caused by military operations and shortcomings in the system of land relations regulation. The research is based on the analysis of national legislation, theoretical foundations of rational land use, scientific works of Ukrainian and foreign scientists on this topic, and problematic issues faced by local governments in the process of granting built-up land plots for commercial use. The article substantiates the need to consider the rational use of land in the aggregate of spatial, environmental, and economic aspects and to consider the formation of land plots as the initial stage of rational land use. Enshrining in law the proposed three-pronged definition of rational land use and the norm areas for the allocation of land plots for ownership or lease, will promote a correct perception by all subjects of land relations of the responsibility to maximize the preservation of urban space and will allow the implementation of several mechanisms for saving land resources. Adopting the positive experience of the European Union countries in the transition to comprehensive spatial planning at both the national and local levels can help to solve the problems of rational land use. In the authors’ opinion, the issues outlined in the article are of practical importance and suggest ways to ensure the proportional allocation of land plots within settlements where buildings, structures, and other privately owned real estate are located. Implementing the recommended legal and economic measures will contribute to forming a transparent legal framework in land relations, rational land use, and empowering territorial communities in planning their development.
